 1.   The foregoing rules and regulations of the Richmond Cemetery Company are intended to cover all usual and ordinary situations that may arise in the operation of the Cemetery.  However, it is recognized that it is impossible to anticipate all situations or requests that may occur or arise in the operation of the cemetery.  In the event any such situations or requests not otherwise covered by these rules and regulations arise, then the Board of Trustees of the Richmond Cemetery company will determine the correct procedure to follow giving consideration to how other Kentucky non-profit cemeteries have handled similar situations.

2.   Any person who has purchased one or more grave sites in the Richmond Cemetery shall own the “right to be buried in said grave site or grave sites”. The purchaser shall not have legal title to the land upon which the grave site is situated.  The purchaser of a burial site or sites may be referred to hereinafter as “the owner”, however, legal title and ownership of the land rests solely with the Richmond Cemetery Company.  As such, any person who has heretofore purchased or will hereafter purchase a gravesite owns only the right to be buried or designate who shall be buried in said grave sites.   The ownership, transfer, and inheritance of this right to be buried shall be addressed more specifically in later regulations.
3.   The Richmond Cemetery will not be responsible for damage of any kind caused by the elements, acts of God, common enemies, thieves, vandals, strikers, malicious mischief makers, explosions, unavoidable accidents, invasions, insurrections, riots, terrorists, or caused by the order of any military or civil authority, whether the damage be direct or collateral.  Lost, stolen, or damaged flowers, monuments, gravestones, or decorations are not the responsibility of the Cemetery.  Such items are the sole responsibility of the grave site and lot owners.
4.   The income from funds held by the Richmond Cemetery Company is not intended for and shall not be used for the repair or replacement of any gravestones, monuments, or memorials, nor the replacement of flowers, trees, or plants, nor for the Cemetery to do any special or unusual work anywhere upon any lot pertaining to the reconditioning or replacement of any marble, granite, bronze, or concrete work on any lot thereof in the Cemetery for any damage caused by reasons in the preceding paragraph.  At no time shall the Cemetery be the insurer for the integrity of monuments placed in the Cemetery.  However, the Cemetery may undertake the preservation or restoration of historically significant monuments and markers under such terms and conditions as the Board of Trustees may set out in their minutes.
5.   It shall be the responsibility of the lot or gravesite owner to notify the Cemetery of any change in the owner’s address.  It shall be the responsibility of the owner’s legal representative to notify the Cemetery of the death of the owner and the name and address of those person or persons inheriting the owner’s interest in the gravesite or gravesites.  Notice by the Cemetery sent either to the gravesite owner’s last address on file in the Cemetery records, or publication of such notice in a Richmond Kentucky newspaper, shall be considered sufficient and proper legal notification.  The Cemetery is not responsible for the knowledge of the inheritance of the burial rights of a gravesite owner bequeathed by will unless the Cemetery is duly notified of such bequest. 
6.   No one under 16 years of age is allowed in the Cemetery unless accompanied by a responsible adult.
7.   Pets and other domesticated animals are not permitted in the Cemetery.
8.   Motorcycles, all-terrain vehicles, and bicycles are not permitted in the Cemetery unless they are part of a funeral procession.
9.   For the convenience of gravesite owners and the general public the East Main Street entrance gate will be open from 8:00 a.m. until 4:00 p.m. seven days a week.  The Summit Street entrance gate will be open from 8:00 a.m. until 7:00 p.m. seven days a week from April 1st through October 31st. The Summit Street entrance gate will be open from 8:00 a.m. until 5:00 p.m. from November 1st through March 31st.
10.   The Cemetery reserves the right to prohibit entrance to the Cemetery by the public anytime it deems necessary due to inclement weather, safety of individuals, preservation of the Cemetery, or under similar circumstances warranting the closing of the Cemetery.
11.   All work of any description shall cease while a funeral or interment service is being conducted in the area of the Cemetery where the work is visible or audible from the area of the service.  All trucks, Cemetery employees, and employees’ vehicles, with the exception of the Director of Grounds, or his designee, shall withdraw from view of the burial service.  The Director of Grounds, or his designee, shall withdraw to a reasonable distance so as to be able to view the burial service at a suitable distance.  The Director of Grounds shall notify the other employees when the last person has left the burial service in order that work and normal activities may be resumed.
12.   The Cemetery reserves the right to correct any mistake it may make without expense to the gravesite owner.
13.   A speed limit of 15 miles per hour shall be observed by all vehicles within the bounds of the Cemetery.
14.   Individuals may contribute to a fund for the purpose of special care of lots and grave sites within the Cemetery.  Such contributions may be made for designated lots, or specific grave sites for memorials or other improvements which are consistent with Cemetery policies.
15.   If any person violates any of the Cemetery rules and regulations, the Director of Grounds or the Office Manager shall have the right to refuse admittance to such person or persons to the grounds until such violation or violations, together with the facts or actions giving rise to such violations shall be reported to the Board of Trustees for proper action, and any such violations shall be reported to the Board of Trustees as soon as practicable. 
16.   Certain sections of the Cemetery have been set apart for single graves.  These spaces are filled in regular order.  Certain sections of the Cemetery have been set aside for twelve grave lots.  These lots are not filled in regular order but are filled in the vicinity of lots that have already been sold.  By and through this regulation, the Board of Trustees reiterates the previous action of the Board in 2002, by specifically stating that the current Board of Trustees is not responsible for actions by the prior Board of Trustees, or Cemetery personnel before 2000 by selling grave sites out of proper order and specifically in violation of this provision.  The present regulation is reaffirmed by specifically setting out that no platted lot or grave site is to be sold that is not in the vicinity of other lots or grave sites previously sold without the prior approval of the Board of Trustees.
17.   Any rules and/or regulations that are contrary to these stated rules and regulations AND such amendments or actions have taken place since January 1, 2009, shall be construed as complying with and being incorporated into these rules stated hereafter.
